Singh Farms Waiver and Liability Release Agreement
This Waiver and Liability Release Agreement ("Agreement") is entered into by the undersigned ("Participant") in consideration for being permitted to use the warehouse located at Singh Farms, 494 Sumas Way, Abbotsford, BC, V2S 8E5 ("Premises"), owned by Singh Farms (Gagandeep Singh, Satinder Singh, and Satnam Singh) ("Owners").
By signing this Agreement, the Participant agrees to the following terms and conditions:
1. Assumption of Responsibility and Risk
The Participant agrees to assume full responsibility for:
- Themselves.
- All guests, vendors, or anyone else they bring onto the Premises.
The Participant acknowledges that they are solely responsible for ensuring the safety, behavior, and actions of their guests and vendors while on the Premises.
The Participant voluntarily assumes all risks associated with the use of the Premises, including but not limited to:
- Property damage.
- Personal injury.
- Accidents resulting from the event or activities held on the Premises.
2. Waiver of Liability
The Participant agrees to release, waive, and discharge the Owners and their family members, employees, agents, and representatives from any and all liability, claims, demands, or causes of action arising from:
- Injuries, losses, or damages of any kind sustained by the Participant or their guests during the event.
- Damage or theft of personal property brought to the Premises.
This waiver extends to any claims made by third parties (guests, vendors, or otherwise) related to the event.
3. Responsibility for Damages
The Participant agrees to:
- Accept full responsibility for the actions of their guests, vendors, and anyone else they bring onto the Premises.
- Compensate the Owners for any damages caused to the Premises, equipment, or property as a result of their event or any actions by their guests.
A security deposit of $100 must be paid before the event. This deposit will be refunded after the event, provided no damages occur, and the Premises are left in satisfactory condition.
4. Indemnification
The Participant agrees to indemnify and hold harmless the Owners and their family from any liability or claims brought by third parties arising from:
- Injuries or damages caused by the Participant, their guests, or their vendors.
- Violations of local, provincial, or federal laws during the event.
The Participant agrees to cover all costs, including legal fees, incurred by the Owners as a result of any claims arising from the actions of the Participant or their guests.
5. Event Rules and Guidelines
The Participant agrees to follow all rules and guidelines, including but not limited to:
- Occupancy Limits: No more than 50 people are permitted on the Premises.
- Noise Restrictions: All noise must be contained inside the warehouse after 12:00 AM.
- Alcohol: Any alcohol must be served responsibly and comply with all legal regulations.
- Clean-Up: The Participant is responsible for cleaning up after the event. Failure to clean up will result in forfeiture of the deposit.
The Owners reserve the right to terminate the event immediately if these rules are not followed, with no refund provided.
6. Use of Premises
The Participant agrees that the Premises will not be used for illegal activities or purposes that could harm the reputation of Singh Farms.
The Participant may not modify or alter the Premises without prior written consent from the Owners.
7. Termination of Event by Owners
The Owners reserve the right to terminate the event immediately if:
- There is any violation of this Agreement.
- Guests or vendors engage in illegal or unsafe activities.
- Behavior becomes disruptive, destructive, or dangerous to the Premises or others.
In such cases, no refunds will be issued, and the Participant will remain liable for any damages or cleanup costs.
8. Compliance with Local Regulations
The Participant agrees to comply with all applicable local, provincial, and federal laws, including but not limited to:
- Fire safety codes.
- Noise ordinances.
- Alcohol licensing and consumption regulations.
Failure to comply with these laws may result in termination of the event, forfeiture of the deposit, and additional liability for damages or penalties incurred by the Owners.
9. Acknowledgment of Understanding
The Participant acknowledges that they have read this Agreement, fully understand its terms, and agree to be bound by them.
